TERMS AND CONDITIONS

Pricing:

Monthly Membership contains there major programs: Members can choose any one of these programs or get their programs customized with Laser Genesis Skin Clinic.

3. Ageless Perfection – $229 / month   

Benefits of Monthly Membership:

1. 15% Discount on All in house Sale of Products
2. 10% Discount on Gift Cards
3. 20% Discount of any services purchased outside of the membership.

There can be no substitutions for these services. However, the programs can be customized and mutually agreed upon. Unused treatments in a month cannot be gifted and can only be used by Members. Unused treatments roll over into the next month and can be stockpiled for up to 3 months. Expired treatments have no remaining value.

Memberships are non-refundable and non-transferable.

All membership plans have to be mutually signed and agreed upon in order to bind both parties. All membership plans have a $100 non-refundable Joining fees. Furthermore, all payment cycles will start from either the 1st of the month or the 15th depending on the time your joining. Your account will be debited according to your payment cycle.

Payment Policy:

All payments will be made through a pre-authorized payment account (credit card or debited from your bank account) on the 1st or 15th day of every month depending on the date that you joined.

Appointments & Late and Cancellation Policy:

Our standard 48-hour cancellation policy applies to all members. If you miss, cancel, or change your appointment outside this designated time, you will be charged 50% of the total of your scheduled services, or you may risk forfeiting your treatment. Late arrivals may result in a shortened appointment or rescheduling (charges may apply).

Cancellation:
You can cancel your membership at any time by giving a 30 days notice and $100 cancellation fees will apply if you cancel within the first year of becoming a member. To cancel, you must visit Laser Genesis location to fill out and sign the Membership Cancellation Form and Pre-Authorized Payment Cancellation form from www.cdnpay.ca.

Cancellation requests cannot be made over the phone. Cancellation requests are not retroactive.

There are no refunds and membership fees cannot be prorated if you cancel before your month is over. You may use any accrued treatments for a period of up to 30 days after your final membership payment has been processed.

The waiver of cancellation fees is at the discretion of Laser Genesis Skin Clinic.

Faulty Payments:

Memberships must be purchased with a valid credit/debit card or pre authorized bank deposit only. No other form of payment is accepted.

Memberships cannot be paid using a gift card. LG must be notified of any change in billing address on file, contact and credit card information. If a credit card is declined or automatic payment does not go through, Member must call LG within 7 days to provide a new form of payment. If Member fails to reach out to the Skin Clinic within 7 days, Member forfeits all stockpiled treatments, membership and a $50 service charge will be applied to any declined credit card or pre-authorized payment charges. Your member account will be suspended until a valid form of payment is provided.

No refunds will be given for any remaining unused treatments.

Freeze Policy:

Accounts can be frozen for up to 3 months once in a 12-month period. Members must be current with payments and make a minimum of 3 consecutive payments in order to be eligible to freeze. Freeze will begin immediately after the most recent successful billing cycle, not the freeze date. During a freeze, stockpiled treatments are retained until unfreezing. Treatments can’t be used while Membership is frozen.

Class Action ArbitrationWaiver & Indemnification:

I acknowledge that the exclusive method for resolving any controversy, dispute, or claim arising out of or with respect to my LG Monthly Membership Program, including the construction and scope of this agreement, shall be by Binding Arbitration. Such arbitration shall be before and in accordance with the rules and regulations of the Canadian Arbitration Association. Any arbitration shall be held in Mississauga, Ontario and the parties hereby waive any objections that they may have based on improper venue. The Arbitrator or Arbitrators shall apply the laws of the Province of Ontario.

Member and LG agree to bring any dispute against the other party in our respective individual capacities and not as a plaintiff or class member in any purported class, representative proceeding or as an association. In addition, we each agree that disputes shall be arbitrated only on an individual basis and not in a class, consolidated or representative action.

ARBITRATOR DOES NOT HAVE THE POWER TO VARY THESE PROVISIONS.

Member and LG agree to waive any right to a trial by jury. Notwithstanding anything to the contrary in this Agreement, either party may bring suit in court seeking an injunction or other equitable relief arising out of or relating to claims that the other party’s conduct may cause the other irreparable injury. In the event LG is the prevailing party in any Dispute, subject to any exceptions, Member shall pay LG all reasonable attorneys’ fees and costs incurred by LG in connection with any Dispute.

To the extent allowed under applicable law, Member agrees to defend, indemnify and hold LG, its affiliated and related entities, and any of its respective officers, directors, agents and employees, harmless from and against any claims, lawsuits, investigations, penalties, damages, losses or expenses (including but not limited to reasonable attorneys’ fees and costs) arising out of or relating to any breach or alleged breach by Member of this Agreement, or the representations and warranties made in this Agreement.
